Statement of L. W. Barker

On the 4th day of June 1868, I was present when Justice J. M Beavers was holding his court in the trial of Weaver & others, standing in the door during the whole time, and at the time Beavers said to Mr Sayers I fine you ten dollars, and again remarked I fine you fifty Dollars, I looked around, and positively state that John T Jones Sheriff was not in the room, He came into the Room afterwards, and the first and only order to the Sheriff was "take the prisoners to jail" I will also state the County Court was in cession at the same time, and that Jones was waiting on said Court, and that Nat Morris Constable, and not Jones was waiting on Beavers Court, I will further state that some half an hour after said Beavers had adjourned his Court, I was present at said Beavers office, "when he Beavers said to Mr Jones "I fine Mr Sayers fifty dollars, take him in custody till the fine is paid" and Mr Jones replied Mr Beavers your Court is dissolved, I cannot execute your order
