Personally appeared before the undersigned authority, John J Smith, who being by me duly sworn upon oath says, that on the 4th day of June A.D. 1868, he was present at the court house out side of door [[strikethrough]] at [[/strikethrough]] of the room where Justice J M Beavers was holding his court, and heard Mr Beavers say, "Mr. Sheriff, arrest Mr Sayers, But did not see the Sheriff. further says that when Mr Beavers came out of the door of room in which he held his court into the main court room [[strikethrough]] he not Mr. Jones, the Sheriff, [[/strikethrough]] he heard him say "Mr Sheriff" take the prisoners to Jail.
