Personally appears of before the undersigned authority J. W. Gilmore, and being by me duly sworn upon his oath says that on the 4th day of June 1868, he was at the court house in the town of Bastrop, and in the room in which Justice J M Beavers was holding his court, and heard Mr Beavers when he imposed the fines [[strikethrough]] of [[/strikethrough]] upon Mr Sayers of ten and fifty dollars, and also when he said, Mr. Sheriff arrest Mr Sayers. And at neither or any of which times did he see the Sheriff in the room. Affiant further says that after Mr. Beavers had gone from the room in which he held his court into the main court room he heard Mr Beavers say, Mr Sheriff "take the prisoners to Jail." [[strikethrough]] which [[/strikethrough]] when the Sheriff came into the room from which Beavers had gone out, and in which the prisoners were, and took the prisoners.
