of the Court was so great that upon his defying me as he did I adjourned the Court and left the Courtroom in disgust and immediately wrote the letter to General Reynolds bearing date June 4th setting forth the facts in the case.

When I ordered the Sheriff to arrest Sayers and hold him until the fine was paid he took no action.  He failed to arrest Sayers and the fine has not been paid.  I did not see the Sheriff to speak to him until I came up to Capt Horton's office which was immediately after my court was broken up.  He then claimed that he did not hear my order to him.  I then in the presence of Capt Horton and his clerk Mr. Barrett repeated my order to him.  He has failed to this date to take Sayers in custody and as I said the fine has not been paid.

When my Court broke up and I left the room I met the Sheriff one step outside of the door and supposed he was going to arrest Sayers.  I believe that the Sheriff was within hearing of my voice when I gave the order to arrest Sayers.  It certainly was his duty to have been there, and as I said I believe he was standing in the door at the time
