I have the honor to make the following Report of my action in the case of two Freedmen by the names of Thom and Americus who were tried for "horse-stealing" by the Curcuit Court recently in session at this place and sentenced by said Court to serve five (5) years each in the States Prison of Texas— Those Freedmen were detained by my Order: as I thought they were being wrongfully punished. But upon a full representation of the case I find that the evidence in the Court shows the case to be quite different to what it was reported at first to me. So I have turned them over to the Sheriff for him to carry out the sentence of the Court. But I must still say that I think their punishment very heavy for the offense for which they were found guilty.
