but before his arrival was waited on by Col Wm. Neyland who told me that that Smith must be released for the good citizens could keep the excitement down no longer. After studying the matter carefully I concluded to release Smith  provided he would take an oath to appear before this civil authorities of the County. He cheerfully took the required oath but the next evening hearing of the arrival of U.S. Troops he took to the woods and has not been seen since, paying no attention to his solemn oath to remain at his home untill his arrest. Mr Jarvis Holmes also murdered a Freedmen without any cause, two men Mitchell and Hodges in Beukville [[Burkeville]] Newton Co. cut a freed boy in the stomach with a bowie knife and then stamped his body into the earth.
