solely for the purpose of procuring his liberty was a nullity he the said Delano held & still holds his profession. The said Thomas Chubb had previous to Delano's arrest threatened him with the same unless Delano would without remuneration surrender said premises. On Delano's refusal the above arrest was made by a U.S. Soldier by order of the said Sturgiss & thus held until he signed the relinquishments of above and agreed to dismiss the suit for title
Shortly thereafter the said Thas Chubb proceeded to Austin and therebefore a U.S Commn. made an affidavit charging the said deed of using cancelled stamps & procured an order for his arrest. He was arrested by Mr Sturgiss  with his soldiers as a deputy marshall & conveyed to Austin as a fellon. The grand jury found a bil for a misdemeanor and he was bailed in the sum of five hundred dollars. About the time of Delano's last or second arrest a soldier at this point deserted went two miles the first day to a farm stated that Sturgiss had sent him there to see that the freedmen on
