to Mrs. Duncan & hailed over to Mr. Duncan, told him to go over and tell Mr. Cowan that he could not get across the river, - he said after Wash was killed he was very proud that he did not go over the river & said if he had gone they would have had him into it. - I never heard Mr. Cowan, Mr. Vick or Mr. Tibb say anything about the killing. -

Cross Examined
I think it was about the twenty-Seventh of April when Ben Cowan was killed. I think it was about the 26 or 27 of May that Wash was killed. I & Jessee Hanks Bill & Alex Stuart were accused of killing Ben Cowan. - Since the arrest of Jessee Hanks, Alex & Bill Stuart, I have never seen any one hunting them myself or any of my family. At the time Mr. Vick spoke to me at the river about the corn. I did not tell him about him about Wash going over to measure the corn, did not tell him that any one would go. I agreed to let Mr. Vicks have 10 bushels of corn which I owed Mr. Ward, - if Mr. Ward would pay me 45 pounds of cotton which he owed me. Mr. Vick has always treated me kindly & I have treated him in the same way, I do not know that Mr. Vick has ever taken any part against me, except the time when I saw him with the crowd hunting me. At the time these men rode so close to me I was at the corner of the three plantations, Pattersons, Judge Wallers & Penrices, - Neither Mrs. Vick nor Mrs. Tibb were along the time the men rode so close to me. It was in the day time when these men rode so close to me.
