Testimony of John E McMullen a witness for the Defendants.

I know the witness Bacchus who was examined today. I have known him about 2 years.  I lived at the same place with him for about six months at Mrs. Matthews.  Bacchus was working for Major Fort & Leon Matthews.  I made a statement of a settlement between the two boys Bacchus & Os., & Major Fort & Leon Matthews.  The witness says that he knows that Capt Hunt stayed all night there and that Bacchus put up his horse.  He says Capt Hunt came late in the evening.  Mr. Matthews told him he would [[strikethrough]] he would [[/strikethrough]] have the horse put-up when the boys came - before they did so suppy was ready.  We all went in except Leon Matthews, Capt. Hunt, Major Fort and myself - about the time we were through eating I came out and heard a noise at the gate.  Saw Mr. Matthews have Bacchus collared.  I cannot say that I knew his general character for truth and veracity.  I knew that Major Fort bought Bacchus some shoes, was with him when he bought them. immediately after Bacchus was collared I saw Mr. Matthews, hand Capt Hunt some tobacco, before he did so Capt Hunt looked in his saddle bags & said he had some of that kind in his saddle bags & looked to see if it was there.
