Burk (FM) living at J.W. Fosters & Trammells near Belmont was attacked by two white men names unknown beaten and shot at as he was running from the house This occurred as I was returning from Gonzales on Saturday the 29th ultimo. 

I saw the man Burk running, went back with him, when upon approaching the house two men mounted & rode off at full speed. I had no means of arresting them having no soldiers with me. I however made an investigation where it appeared that upon Burks return from Gonzales one of these men had been riding his horse without permission to which he objected whereupon the man assisted by another jumped upon him & beat him saying he would ride his horse whenever he damned pleased Burk gets loose runs off, and as he goes some of the party fire at him. Mr Trammell being present instead of interfering to prevent rather urged them on. 

Cited the parties to appear on the 6th inst at Belmont for investigation & settlement
