Complains that Deft. has in his possession a receipt for his discharge as a Union Soldier, which he unlawfully withholds. Also that he labored for Deft. six mos. and has had no settlement.

Complains that Deft. has discharged him without just cause or provocation.
Sept. 11. Letter to Deft., asking him to be present on 13th inst., with his witnesses.
Sept. 13. Parties present and cause tried. 
Defense_ that Plff. positively refused to obey the orders of Deft. and the head man of the squad, in the discharge of an ordinary duty, afterwards performed by others.
Sustained by the evidence of the Deft., Ben
Gray, the head man, and others, and admitted
by Plff.
Condition in the contract, that in case of 
discharge with sufficient cause, all wages
due should be forfeited, or annuled. 
The amount due Plff. for wages, to be paid, according to the contract, on the 31st of December, 1867. 
Complaint dismissed.
