Ben Avery (freedman) being sworn states as follows, Mr. David James came to the Stable of Mr. Hargrove, where I am employed as an ostler, and asked for his horse, I saddled his horse and lead him to the door. Mr. James then called me a damned son of a bitch, and caught me by my shirt collar, and with a knife attempted to cut my throat, whereupon Mr Harry caught him by the arm and begged of him, James, not to kill me.  James then let go his hold of me and I ran away.
