Marshall, Texas. April 9th 1868.

Wm. Smith, freedman, being sworn, states as follows: I contracted with Mr. Clark of Harrison county to work on his plantation. On or about the 28th day of Febr. Dr. Clark informed me, that he had bough a mule which I owned from Anthony Brooks, freedman. I told Mr. Clark, that the mule was mine and that he could not take it from me. Clark then got his shot gun and threatened to kill me. I left his place and complained to Squire Winsley, who refused to issue a writ for the arrest of Clark.
