Respectfully returned to Major Gen N.S. Miles Comdg. &c with the remark that before the time to restore this property had arrived Mr. Armstead raised a question as to the improvements Govt. had put upon the mill, and which it was my duty to remove, unless he (Mr. A.) would allow a fair consideration for them. Mr. A. chose to appeal
to Col. Brown, by whom, the order to restore was suspended and the matter was referred by Col. Brown to Gen. Howard Comr., and up to the date of Mr A's last note to Col. Brown Jan 1, 1866, no answer had been returned. On this last statement 
Col. Brown endorsed Jan. 5, 1866 as follows:- "Respectfully referred to Capt. Wilder with the suggestion that tho question of improvements on the estate of Mr Armstead, be submitted to arbitrators, to be approved, one by Capt. Wilder and one by Mr A. The two if unable to agree to choose a third, Either party reserving the right of appeal
