large bay horse he (Def't.) had, belonged to Pltf. Witness knows Pltf. to be honest and truthful, and considers it a scheme on the part of Deft. to rob Pltf. of the horse. Defendant states that in March 1865 Pltf asked him if he wanted to buy the horse in question: Def't. offered Pltf. a small bay horse and $200. (Confederate) for him, which offer was accepted and the trade made. Def't. produced as title to horse, a Permit from Gen. Patrick to keep a horse branded "U.S." dated May 24th/6. Henry Brisbee testifies that he was at Dr. Macon's on the 29th of March/65; that Fox then proposed to Clayton that they trade horses: that Def't offered a small bay horse and some "loot" for Pltf's large bay horse (in question): that he subsequently saw Pltf. and Def't together and both acknowledged the trade: that Pltf. subsequently offered the horse obtained from Deft for $50. in "Greenbacks" The answers of this witness to queries in cross-examination by Richmond T. Lacy, Counsel for Pltf. were so contradictory and given in such a hesitating manner as to invalidate his whole testimony. Mr. Wm. C. Wade, recalled, testifies that he saw Pltf with Deft's horse; that Pltf. loaned him said horse to go to Richmond: that he was with Deft when he swore that he picked up the horse in question at the White House after the U.S. Forces left: object of the oath was to get title to him.
