The Plaintiff in this case purchased from the defendant a house and lot in Fairfax, Culpepper Co for $1500 - $1000 in cash and the balance in a bond. The latter instrument is produced with a receipt for $250 and interestto the time of that payment and the bond itself is probably the evidence of the payment of the whole remainder of purchase money. It is asserted and seems clear that Simpson has fully complied with his part of the contract and that the deft. Bowman is both in law and equity bound to make him a good deed of conveyance for the land.

No defense appears among the papers submitted, but, from the Bill of Complaint and offer of proof, it seems that Bowman never paid the purchase money to his vendor of the lot in question and now is about selling his other property in fraud of creditors and absconding from the neighborhood. He has also, as stated, procured that the other property is to be sold, should be in the name of his
