informed me that the preliminary hearing would be had at the hands of Esquire Neal ten miles from this place.  I requested him to have it here, as my horse was lame and it would be difficult for me to get there, but he objected to doing so.  On the day appointed, an extremely warm day, I started for Mr. Neal's on horseback, rode about two miles where my horse became so lame that I could not ride any farther, got down and walked eight miles that I might be present at the hearing as it was an important case.  I reached Mr. Neal's about 12 oclock PM and staid until 1.30 P.M. when Messers Jackson & Neal called me into the house, showed me the warrant, subpoenas &c, said they had been issued in due forms that the defendant was present, but the the plaintiff had not appeared, and said So what ought we to do with the case?  I said, I have nothing to do with it gentlemen, you must act on your own responsibility.  They still urged me to advise them, this I refused to do, telling them to act on their
