Respectfully returned to Brevet Maj T. F. P. Crandon A.Q.M and Supt 4th Dist Va with the following report.

I have no papers connected with this case. I did make a full report of it in my monthly reports. The facts of the case as far as I could learn are as follows.

John Moore came to me some time ago and stated his case to me, and on his sworn informations one of our Magistrates issued a warrant for the arrest of the accused, Mr John A Allen. (Making the third time he was arrested for this same offence - each time Allen was dismissed once with a reprimand for not shooting Moore - this in Charlottville [[Charlottesville]] Va)- on the examination all of the Colored witnesses they contradicted each other in almost every particular, they were seperately examined and were not allowed to hear each others testimony - and on their testimony - (there were none introduced for the defence) the case was dismissed.

on the examination the following seems to be how the matters stands- 
A. Mr Wickham was the owner of a plantation of which the deft John A Allen was overseer, Mr Wickham instructed Allen to have Moore removed from the plantation as it was found out that his (Moore's) cabin was the resort of bad characters, and a receptacle for stolen goods &c  Allen was sick at the time but as soon as he could ride out he rode over to Moore's cabin and told him that he must look out for a home elsewhere, that such were Mr Wickhams orders &c upon which Moore got very insolent. and said he was a freeman, and did not intend to leave, that he had as much right there as any one else &c  Allen then left him, riding towards another of the cabins, Moore following him and abusing him all the time, (Moore is a cripple & walks with a crutch) until he came to the cabin of another of the Moores, who said "Kill the son of a B-" when Moore closed on Allen and struck him in the hand cutting it. Allen then drew him pistol & snapped it Moore, (It is question, if the pistol was fired at all - Allen, claims that the pistol missed fire, and that all the loads were in it when he got home) - I am of opinion that if Moore was a White man the case would be no different
