At the request of Mrs. Jennie Ouderkirk I give the following statement of the evidence given in before the County Court of Henrico at the examination of Alfred Ouderkirk charged with felony. I do not pretend to say that the following statement is absolutely correct but only so far as my memory serves me.

It was proven by the commonwealth that a mule was stolen on the night of the 17th of June from the American Telegraph Stables - that it was traced to Manchester - that Ouderkirk was seen to leave town with a mule - that the police officer of that town & Mr. Doran Agt. of the company started in pursuit of him - that they arrested him about two o'clock that night, at Clover Hill Coal Pitts - that he at first said he bought the mule from a negro and said afterwards from a white man - they found the mule in his possession to be the stolen one. 

It was proven by the defense that the prisoner was at home at Mrs. Cottams all Sunday, (the day before the theft) & all that night - that on Sunday afternoon a negro came to Ouderkirk & offered to sell him a mule for $150 - the prisoner told him if he was a good mule & suited, he would give him $125 & that he must bring him the mule very early in the morning, as he had to go to Clover Hill that day & should take the cows if the mule came not in time - [[It?]] was [[fine?]]-
