Lieut:
I have just rec'd your communication of the 11th inst, asking for information in regard to a Suit at law in my office in which John Rud is plaintiff and Simon Defainett (freedman) is defendant— of a plea of trespass on the case- Damages $250.00 — I hasten to reply— 

John Rudd Sued out of this office on the 3rd day of February 1866 a Summons against Simon Defarnett of a plea of trespass on the case damages $250.00  Commanding him to appear at the Clerks office to answer the said Complaint- which summons was returned by the sheriff "Executed by delivering to said Defarnett a true copy of the Summons."

And at Rules held in the said Clerk's office on the first Monday in March 1866 - The defendant Simon Defarnett being Summoned and not appearing, on the motion of the plaintiff John Rudd, by his attorney, it is ordered, that Judgment be entered for the Said plaintiff against the Said defendant, for what
