Respectfully returned to Capt. A.S. Flagg AQM and Supt with the following statement of facts.
In the latter part of Nov. 1865, the property in question was advertized for sale to satisfy the judgments of the creditors of S.S. Nottingham, and a few days before christmas the sale took place - 
Col. Rush becoming the purchaser of the piece of woodland from which the 30 pc's. of timber were afterward cut. The commissioners in the case sold the property subject [[underlined]] to the action of the Freedmens Bureau. I knew nothing of the sale till two days after it was made, but immediately upon hearing of it, I warned the commissioners that in obedience to my orders in the case, I should retain possession of the property, and warned them not to receive any of the purchase money, and although the deeds were executed by them, the commissioners refused any money till such time as the property was properly restored by order of Col. Brown. In the face of all this and with a knowledge that the sale was made subject to the orders of the Bureau, he having been informed of this by the Atty of the commissioners, Col. Rush proceeded to cut timber from the land, and learning this, the removal of it was prohibited as it was government property by order of Capt. Flagg. The timber is not as stated in Col Rush's com. at the mill, but is a part on the land and a part on the banks of a creek ready for rafting to the mill. The lumber is still held by me subject to the orders of Capt Flagg
