Mr John Brooks was informed through some source, that on a certain night during the month of May 1866, some eight colered prisoners would attempt to cut their way out of jail, and on the said night Mr Brooks placed himself in a window over the cell in which said prisoners were confined.

The female prisoners became aware of the fact, and kept a watch from their window to see what would happen.

The prisoners were allowed to cut out of their cell into the jail yard, which is surrounded by a brick wall very thick and some twenty feet in height.  When the prisoners got into the yard, Mr Brooks without saying anything, fired several shots at them saying as he fired, "get into your cells G–d d–n you", the men ran to their cell, Mr Brooks went to their cell and with a revolver and rifle fired many shots at them, seriously wounding two and severely wounding four of five others.  The men aforesaid while being shot at would implore Mr Brooks not to shoot them any more, and Brooks
