A short time since I addressed a communication to Lt. Cook at Staunton about a case in this county, that I learn has been sent to you through him and as yet I have heard nothing from it, my object now is to state the case to you, it is this. 

some time last Spring or Winter Charles Morgan Gum of this co. instituted a suit against John Green to recover the value of a horse taken from him in the Spring of 1864 by s'd John Green, it is an action of Trover, the circumstances of the case is about this; in May 1864, the U.S. forces under Col. Hall came into this county & the deft. John Green with them, they were in here some few days, whilst they were here, this deft. took his brothers horse or at least [[strikethrough]] so [[/strikethrough]] on their return he had the horse in possession, when they arrived at Huttonsville in Randolph Co. West. Va., there the command halted, to gather up all the captured property, have it branded & turned over to the proper A.Q.M. I suppose, it was contended by some of the officers that the Grey-horse that John Green claimed was not his, but he insisted it was & finally Col. Hall had the horse branded U.S, things
