then went on until they arrived at Beverly some ten miles further, when the command halted again, at this point the deft. John Green insisted that the horse branded by Col. Hall was his, the Col. then reconsidered the matter & gave this deft. a good mare & colt in place of the Grey horse, all these facts we can establish by good evidence, this deft admitted that he had taken his brothers horse (whilst he was in West Va.) & intended to pay him for the horse. I understand that evidence is being forwarded to you by the deft. John Green, my client Sir only asks a fair chance & if you have taken cognizance of the case, before you give a decision in the case, we would most respectfully ask leave to forward evidence on our side, so that the case can be fully before you & that Justice & Equity may be done in the premises, This case is now pending in the Circuit court of this county before Judge John. S. Franks.

Sir, I am requested to ask your attention to another case that has been before you, it is the case of Robert Botkin again, at Abraham Burket, this case I will state to you & then state what the court of this county have done in the premises, sometime in May 1865 after the surrender of Genl.
