Lee, Botkin had his horse stolen, soon after he learned that this man Burket was the man who had taken the horse, he employed a man to go to West Va. in search of his stolen horse (at a great expense) this man went to West Va. succeeded after a long search in finding the horse, got it & returned it to Robt. Botkin, at the last October Term 1865 of our Circuit Court Abrm. Burket was presented by the Grand Jury for the Larceny of this horse, then Botkin made off an account against Burkett for the trouble & expense in recovering his stolen horse & as Burket had gone off, under the 3rd sec. of the Code of Va., he took out an attachment against the goods & chattels of s'd Burkett (the amt of his act was $550.60, for getting his horse back) he had it levied upon some sheep & tobacco, at the last Aprl. Term of our co. court, we obtained judgement against Burket for the amt. of our act. & on order of sale for the property levied upon & about the time the Sheriff was going to sell Judge Luky from Staunton came out here on some business & he suspended the sale, Thus things have been until your order came restoring the property to Burket, Mr Burket as we are informed represented himself to the Beaureau officers at Staunton as a Union man
