I went upon the ground with the two arbitrators appointed severally by Mr. Ellison and Capt Wilder, the third who was to be referee in case of disagreement, tho’ notified was not present. Capt. Wilder was present but Mr. Ellison, tho’ notified to meet me was not. There was also a witness before the arbitrators to describe the condition of the engine as when removed and the large additions and repairs made to it. The arbitrators present agreed in their award thereby calling for no further delay in waiting for the third referee. I directed them chiefly to estimate the value of the property when removed and its actual value now. They made the award as follows – on 14th inst – “As the Mill & Engine stood in the wood $500. As the Mill & Engine now stands $900 Repairs on Mill & Engine put there by “Capt” Hunt – $850– Signed Wm Bartlett Chas Bliven" I afterward took pains to see Mr Ellison. He did not seem to be satisfied, but he could not give any reason to me against the award.
