amount equal or exceeding the value of the interest of the said Wynn in the Saw Mill & that Lewis Ellison has an equitable lien upon the interest of Wynn in the Mill to the amount of the sum due him from his late copartner. That the time the Mill was taken possession of by the Government it was greatly out of repair and many parts missing, it has since been repaired and missing parts supplied at an expense of about $600. That the Mill ought to be restored to the claimant Lewis Ellison, that the repairing made upon said Mill since its seizure by Government are of much more value than its use and cost of removing back & therefore no damage should the paid for its seizure & use.
