The Deponent being first duly sworn deposes as follows.
1. Question, by Joseph M. Carrington, counsel for the Defts.
State whether you ever had any conversation with Polly Fortune, in relation to the house & lot claimed by her, a part of the lot purchased by Agnes Peters of Geo. M. Carrington, Richard A. Carrington & others; & on which there is now a deed of trust to me, for the benefit of Hiram W. Tyler; & if so, at what time did said Conversation occur, and what was the purpose of it?
Ans. I have had a conversation with Polly about her house & lot. It was since this last Christmas, on a saturday evening, before she moved, which was on a monday morning. She said Mr. Carrington (Joseph M.) had given her the key to move back to her house; & she was waiting there (Saturday evening) for him, Mr. Carrington, to come along & go down town with her on some other business. She said she wanted me to help her to move back to her house. When I got to her house on monday morning, she had moved back to her house, every thing except her wood. I brought one load of wood for her, & the three horse cart brought all the balance. I did n't charge her any thing for bringing of it. She said her lawyers had given her permission to move back into the house again.
2nd Question, by same. Do you know how long this house remained [[strikethrough]] Had you any [[/strikethrough]] unoccupied, before Polly moved back to it in the manner you have above stated; & who had the control of the premises during that time?
Answer. I don't know 'zactly how long. 'Spose it might be a fortnight. Don't think it could have been much longer
