I am in receipt of your communication of Feby 12 1867 and in reply I would say it will hardly be safe for me to pay this money over to the legatees under the will of John W. Wyatt until after the expiration of eighteen months; as according to the laws of the State of New York an executor or administrator to protect himself must publish for claims six months and cannot settle an estate in less time than eighteen months from the granting of letters testamentary or of administration.  How many liabilities there were against the testator at the time of his death I cant say I don't now know of any if there are any these legacies are subject to their payment. I am very sorry the money cannot be paid over immediately.

It would expediate matters and save expenses if these two parties would admit service of a notice of citation as otherwise (they being out of this State) a notice of citation must be published six weeks in the state paper. I enclose a notice, please get the signatures of these two persons to the admission of service, have them sign their names or make their marks in the presence of some person then have that person sign and swear to the affidavit written under the admission after which get the County Clerk to certify to the official character
