Reports having attended, on 12th inst, the trial of Jno, Brennan pvt 29th U.S. Inf'ty charged with killing Thomas W. Hall (col'd), before the examining court of Magistrates, who after hearing the testimony on both sides, discharged him, under the plea he was acting under superior orders.

Respectfully forwarded to Bvt Brig. Genl O. Brown A.A.A.G. Bureau &c. Attention is invited to a report made and forwarded to your Office on the 4th inst, in regard to the shooting of Hall by Brennan. In a conversation with the Commanding Officer of Libby Prison, he informed me that no order had been issued by him, which authorized Brennan shooting Hall. It seems strange that the counsel for the prisoner did not summons the Commanding Officer of Libby Prison and by him prove that such order had been issued. I am of the 

opinion that Brennan should be arrested by the Bureau under Section 14 of "An act to continue in force and to amend an Act establishing a Bureau for the relief of, Freedmen and Refugees and for other purposes" and be tried for the murder of Hall.
