Captain - I have the honor to make the following report relative to the enclosed case, referred for investigation and report. On receipt of the original communication with endorsements, I made every effort in my power to have the parties appear without delay to these Hd. Quarters for investigation of the facts in the case, but although repeatedly summoned, yet they either failed to receive my communications, sent through the mails, or did not comply with the instructions therein contained and up to the present several of the most important of the witnesses, have failed to appear in pursuance to orders. Those referred to, live in Floyd County and are the parties on whose premises, according to the testimony of Mr. Spangler, the horse was sent to pasture. The following is the statement made on oath, a short time since by Mr Soloman Spangler, who himself, after long delay, reported to this office. The horse referred to, he affirms is now in his possession, but in May 1866 was sent out to pasture -
