Statement of Minor F Davis.

I enlisted in the rebel service at the breaking out the war and deserted, and was caught three different times and finally made my way into the Federal lines and enlisted in the 2nd Dist. U.S. Vols. On the 19th November 1866, my cousin, John L. Davis came to the house where I lived, and called me a liar. I says to him, John, I don't want any fuss with you. You get away from here. I will give you just five minutes to get away from here. My father came up and says, John, don't you leave, it is my place. At that, John walks up to me, and strikes me three times with his fist, and at that, I picked up a piece of stick, and broke it over his head. He still followed me with my father, until we  had reached the woodpile. Father then ran in between us, and says to me, "You God damned vile rascal, he (meaning John) ought to kill you." At that, I picked up an axe, and struck father with it, on the right arm (not cutting him)
