Pleas and Proceedings before the Judge of our Circuit Court of Essex County at the Courthouse thereof on the 13th day of November 1866 that being the Novem Term of the said court.

The Commonwealth of Virginia

Robert Johnson, Richard Johnson, and Horace Bird}

Upon a presentment of the Grand Jury made against the defendants for a Riot.

Be it remembered that heretofore to wit:  At a Circuit Court begun and held for Essex County at the Courthouse in Tappahannock on Wednesday the 25th day of April 1866, A Grand Jury for the body of the County to wit Gabriel H. Dillard "Foreman", Edward Powers, Robert P. W. Fountleroy, Elzer Fogg, Thomas B. Garnett, John J. Hoskins, James A Dunn, Thomas H. Limcoe, Robert A. Ware, Peter Campbell, Phillip A. Sanely, Lowry Elliott, Peter E. Seward, George F. Ramsey, Arthur J. Derieux, Richard J. Muse, Leonard P Sule and Thomas W Lewis who being elected impaneled and sworn as a Jury of Inquest received their charge and retired to consider of their presentments and after some time returned unto Court and Indicted Robert Johnson, Richard Johnson and Horace Bird for unlawfully riotously and routously assembling and gathering themselves together with divers others on the 26 day of March 1866.

And the Attorney for the Commonwealth declaring he has nothing further for the Grand Jury they are discharged.  And on the motion of the said Attorney for the Commonwealth a summons is awarded against the several offenders upon the Indictment aforesaid against them to answer the said Indictment which said Summons is to be directed to the Sheriff of this County and made returnable to the first day of November Term next.

The following is a copy of the Indictment referred to on the foregoing order with the endorsement of the foreman of the Grand Jury thereon to wit:

I saw on a previous page the charge was "Riot Route" which goes with "Riotously and routoriously" ... I found this: Every person who remains at the place of a riot, route or unlawful assembly after being told to disperse = misdemeanor
