for the Commonwealth and for reasons appearing to the Court. It is considered by the Court that the Judgement rendered yesterday, on the verdict of the Jury then returned assessing pecuniary fines against the Defendants for the said fines, and the Commonwealths costs in this behalf expended be enlarged in this, that the said defendant be imprisoned one day for the offence aforesaid.

On the 4" day of December, 1866 a Capias for Sixty two dollars and fifty cents each for the fines, and Twenty two dollars and thirty Cents the whole Costs of the prosecution against all the defendants issued from the Clerks Office of the said Court returnable to the first monday in February 1867 and was delivered on the 8" day of December 1866 to Thomas M Henley deputy for Jno S Doughton Sheriff and has never been returned to the Clerk's Office of the said Court.
