to lend it to him, proposing at the same time to be taken into his employment. There had never been any partnership between them. Mr Doherty took the money & gave receipts of which the following are copies.

The money was always represented to be his wife's. Owing to Healey's habitual drunkeness Mr Doherty was compelled to discharge him from his employment. During the time that, Healey was employed, he got from Mr Doherty $1800 00, more than his wages would amount to, but which Doherty did not refuse to give him, because he had his money in hand & expected to deduct it, at the trial settlement. When Healey, discharged by Doherty, presented the above due bills, which were payable on demand, he demanded to be paid the whole amt  expressed to be due on the face, & refused to make
