For the defence William Robinson Cold was sworn he testified, that he was at the meeting at Reedy Mills, and a tall colored man came to him, and told him his name was Fox. That he had papers from the big men at Washington That he Fox was made Capt of the Guards at all the Meetings, that any one who would not do as he said their heads would be cut off, That he had orders to make every one attend their Meetings, and if they did not he must make them, he (Fox) ordered witness to fall in & go with them, but he was excused as he had a boil on him, Witness was at Trices in Christmas 1865, John Chew was with him each of them drove an ox team to move of some of the people, Witness went into a cabin. Trice followed him and [[strikethrough]] asked [[/strikethrough]] said to him I thought I told you not to come here any more, Witness was very cold and [[strikethrough]] could [[/strikethrough]] did not answer, Chew said I thought good behavior would carry a man any place - then Trice [[strikethrough]] chased [[/strikethrough]] picked up an axe and rushed at him, Chew said please not strike him that he would leave, that he ran out the door and Trice followed him up with the axe, and that he fired two Shots at him, That a Mr Ball fired 6 shots at him while he was running away but did not hit him,

Jerry Anderson Cold was examined over the same ground, he and Robinson contradicted each other in almost every particular (When the Witnesses for the defence were sworn the Counsel for the Commonwealth asked that while one witness was on the stand the rest be kept out of hearing - which was done)
