I called the attention of the Commonwealths Atty. to the case, he had Fogg presented by the Grand Jury and it was tried last week. Mr. Jas. E. Fogg was acquitted.

I have given the true facts in the case, precisely as it was given in evidence in Court, I was brought in Court as a witness. There was no evidence given in Court that she threatened to do him injury, neither did she make such a threat. If the mere utterance of such language as she used is going to justify him in cutting her head open I pitty these poor beings who are kicked about and forced to utter insolent language that if properly treated they would never think of.
