posession of another man, who had picked it up as a stray in the neighborhood of where Preston also said he had turned it loose, about five miles back of where he was himself captured.

Today the case, in as far as the alleged larceny was concerned, came up before the Franklin Co. Court, which convened here yesterday in quarterly session; but sitting at the time merely as an examining Court. The members comprising it were as follows - to wit "Thos H. Bernard"(Hudson's Uncle)- Presiding Justice of the County - and "Francis S. Hutcherson", "Elya B. Wade", "George W. Finney", and "Steward Tinsley", justices of the Peace. Four white witnesses, including Hudson, were examined - such in the presence of the others for the Commonwealth; and they all testified to the facts substantially as have been previously set forth. There were no witnesses for the Defense. The Prisoner's mother and step father, who saw the shooting, were not either of them present; they having like numerous other persons living at a distance without doubt been prevented from attending court by the intervening rivers, owning to the late heavy and continuous rains, & in the total absence of bridges, being [[strikethrough]] too [[/strikethrough]] far too high to be forded.

When the examination commenced, Mr. "Edmond Irving", the  Prisoner's Counsel, was not in court; but his Associate, Mr. "Geo. E Dennis", gave his attention to the case. Hudson, the first witness called, had concluded his statement -  having also given in, without objection on the part of the Defense, the confessions elicited from the Prisoner after he had been shot - and was being cross questioned by Mr. Dennis, when Mr. Irving, in a painful state of intoxication, entered the bar, and began wrangling with his associate - unchecked by the
