"C." Lieutenant Samuel Walker informs me that you wished to know why it was I did not give him Notice in that Case of his and Patterson I see no Law requireing me to give him notice, in the case of new trials it is the law that the party should have 5 days notice if he is not present at the time, in case of an Apeal to Court, it was Pattersons duty to give Samuel Walker ten days notice, before the Court came on that a motion would be made to try the appeal, which Notice Patterson or his lawer said had been given. I was on the Bench at the time and the Court asked the question if the opisite party had Legal Notice, if I have ered in any way in the case it has been and error of the head and not of the heart for I know I aimed to do right March 14th 1867 Most Respectfully E.B.
