Anderson vs Tracy} Unlawful Detaine,
Be it remembered that upon the trial of this cause the Pltff to maintain his action took the stand, a witness and stated upon oath (There is not notes of testimony of J.W. Pugh) and further to maintain said action the said Pltff offered as evidence the aforesaid bonds, which were in the words & figures viz (here insert them) Whereupon the Deft moved the court to exclude said bonds from the July because the demand of the plaintiff was based upon a contract of renting for a period of (3) three years & the Pltff had not produced as required by the Stat. of Frauds a contract, agreement or memda in writing signed [[strikethrough]] copied [[/strikethrough]] by the Deft. the party to be charged by the terms of the contract and against whom said contract were to be enforced by her agent. Which motion of the Deft was overruled by the Court & the said bonds and each of them admitted to be used as evidence to prove a renting on he part of said Pltff. for a period of one year. To which ruling of the court the Deft excepts & prays that this her [[strikethrough]] here [[/strikethrough]] Bill of Exception may be signed sealed & enrolled by the Court which is accordingly done.
