witness could not say. what he was doing whilst so stooping, Patterson then immediately turned and started in the direction of his house, and when he had made a step or two in that direction he heard the report of what of he supposed to be a pistol (in the direction of the prisoner and at the same time felt a stinging sensation in the region of his neck. he then turned towards the prisoner and saw him about in the act of starting from the place he had before observed him in: he (Patterson) remarked to him (the prisoner) that he would fix him for that: Patterson then returned to his house, arriving at his house. Patterson woke up his wife and sent up stairs and had his son awakened, he then sent for a Physician who on his arrival and Pattersons' house examined Patterson and found him suffering from a gun shot wound which he supposed had been produced by a shot from a pistol, a ball had entered the upper portion of the back about two inches to the right of the spinal column and which was found embedded in one of the outward processes of the second or third vertebra, at a distance of about two inches from the surface, he raised the ball from its bed, but did not extract it, the messenger (Rob Roy) a colored person whom Patterson despatched for the Physician (before referred to) met with the prisoner a little before sunrise about a mile from Pattersons' house when Rob Roy first discovered the prisoner he was was sitting on a fence some distance ahead of him (Rob" Roy) the prisoner about this
