away.  Eastham ordered him to bring him back and give him to him to pay for the half year's work which he was losing by going away.  Menifee had not received any pay from Eastham for the half year he had worked, and told Eastham that he was willing to lose that, but would not give up the horse.  Eastham met Menifee on the street in Flint Hill Rappahannock Co. Va. and told him to have the horse at his place at work the following day, Monday July    1866.  Menifee said he would not, Eastham ran at Menifee and struck him twice with a stick, Menifee took the stick away from him, when Eastham drawed his revolver, Menifee then struck Eastham with the stick; Eastham fired his revolver at his twice shooting him once through the nose and once through the breast, from the effect of which Menifee died the same day."

All the parties interested live at and near Flint Hill, Rappahannock Co. Va.  Eastham is preparing to leave in case his action is brought before the military authorities, if you deem an investigation necessary it will be necessary to secure Eastham personally before he can learn that an investigation has been ordered.
