the evidence, the said Magistrate gave the prisoner the choice to either go to jail for further trial, or to take thirty nine lashes, and to leave the county.  The latter, it was proven on reliable evidence, that the magistrate influenced the prisoner to except, and that Walker Freeman inflicted the punishment.

2d.  That the said James. T. Noell a Magistrate of Bedford County Virginia, did inflict this punishment, without any evidence to show, that the said Daniel Jeter (Cold) was guilty of the charge.
