States that M.E. Price the owner of the aband Lands in possession of the Bureau at that place, sold the property on the 1' of Dec. 1865 to T.A. Kirwan, who on the 19' May 1866 sold the same to Mrs Mary E. Beal.

That Price originally bought the property of the U.S. Govt. to whom he owed a balance of $260 — and on the transfer of the property to Mrs Beal, the balance due the Govt. was paid, and a Deed bearing date July 26. 1866. was given by the Sec. of War for the same. States that Mrs Beal has now the right and title to the property and is now in possession, and recommends that it be dropped from report.

Respectfully referred to Bt. Brig. Gen O. Brown, A.A.A.G. for instructions with the following remarks —

The Records of this office show that this property was received from the Treasury Dept. as abandoned, Sept. 14' 1865. It was then Leased to Mrs Mary A. Russell at $4- per mo. Rent was paid by her for Augt. Sept. Oct. and Nov. 1865. Since that time the Asst. Supt. at Harpers Ferry has reported her as too poor to pay the rent, and as no other tenant could be found she was allowed to continue in possession. No application has been received in this office from Mr. Price for the restoration of this property; nor has Lieut. Higgs received any authority from me to yield possession of this property to Mrs Beal, or to any other person.
