I also forward the letters of J.G. Foster Esq in regard to the case. Mr Stone is a man who is afraid to do his duty, and he in a conversation I had with him on the subject showed that he had a predudice against Wolf, stating that Wolf was in the habit of Gambling &c of which I know nothing of. I have been very careful in investigating the case and believe this to be caused by great desire of Dr Shumate and others around the Junction to rid themselves of northern men. Upon Mr Wolfs coming to me I went with him to W.H. Gaines Esq Magistrate of this district who cheerfully gave him a warrant but Mr Lundsford the constable refused to serve it as it was out of his District. Wm. H. Payne (Ex Rebel Genl) Commonwealth attorney told him that if he refused to serve it he would have him indicted by the Grand Jury at the next term Lunsford then went down and arrested the man and took him to Square Stone who let him go on a small recognisance until he should want to try the case. no other parties have been arrested but I expect to have Fant indicted before the Grand Jury if they will do it: I have another case against this Fant which will soon be decided by the county court in regard to his illegally having a colored child bound to him.
I am Major Very Respectfully
