Matilda Watson being sworn states that she borrowed a hammer of a little boy who was playing with it to nail her gate about the 8th or 9th of July that before she was done the boy demanded the hammer saying it was Mr. Martin's and that he must carry it home. He took it and carried it to Mr. Martins and two or three days afterwards she was passing Mr. Martin's house and he asked her what she took his hammer away for, and accused her of stealing it. She denied it and he ordered her away and commenced throwing stones at her. She was then struck making towards home and he followed her hitting her with one stone and then beat her with his fist and kicked her. He said he had a great mind to kill her.
