Robt O Miller sworn. I act as Town Marshall in my Fathers absence - was detailed as S.P. on the 10th inst. I know nothing of the Bar Room difficulty excepting what I saw. I was standing near Col Jordan on the corner near by when his attention was called to it, and went to the room with him - I saw only two colored men there (Harris & Perkins). The soldiers were beating these two men.- The row was quieted, and I passed out after the soldiers - no colored men were there excepting the two named.- There was considerable excitement afterwards. I took several colored men away from the soldiers - the former were beating the latter then - There was considerable danger of a riot that night. 

I came to Col Jordans office next morning to get my mace about 10 AM and returned to the street just as Col Jordan went down & this guard came up street.- this was just as the fight was closing - I ran up to do what I could as policeman to stop the row - when I met one of the guard who shouted out. "There's a dam'd policeman" kill him - and thrust his bayonet at me.- Knocked my stick up and I got out of his way by running - [[strikethrough]] I left my sti [[/strikethrough]] when I came back another soldier named Bow came at me with a stick and struck me across the back.- There was a great deal of excitement & a riot was momentarily looked for.- Col Jordan stopped the riot on Monday evening & Tuesday morning - I think these soldiers are inclined to seek difficulties with colored
