Of the merits of Williams case I know nothing and in justice will say that it was my opinion the man had been drinking but not to excess, when I saw him - Of the fact that he was assaulted Mr Sherard had no reason to doubt, and he must be aware that the usual custom in such cases is to arrest and bind over the accused for trial before the Grand Jury. By Chapter 6.C. IV Sec 1 & 2 of the Code of Virginia, it is clearly the duty of the Justice to examine, on oath the complainant and witnesses and if sees good reason to believe an offence has been committed, he shall issue his warrant for the arrest of the offender.

As therefore Mr Sherard failed to render the protection which the law affords, I respectfully submit that his office be declared vacated and a successor for the same be appointed.
