I have the honor in compliance with your letter of the 4" of September 1867 - respecting the Case of the Commonwealth vs Wm Waugh, mentioned in my report rendered under the provisions of Circular 10 for August 1867, to report, that at this (Nov'r) term of the Circuit Court of Culpeper, Judge Watson presiding, the Counsel for the prisoner made a motion in said Court, for a writ of error or Supersedeas" in said case.

The Judge upon a careful review of the evidence in the case, granted the application, and set the verdict of the County Court aside, and directed a new trial in the county court this (Nov) term of the same (The verdict being for 10 years in Penitentiary by the County Court)
