Walker, my Counsel that in consequence of Whites absence from Norfolk. and no rent or taxes having been paid by him or any one else for two years, to wit. from Jan. 1863 to Jan 1865 I entered on the premises in January 1865 and took possession of land and house under the above covenant of the deed. and immediately rented it out to N.B. Strong who has been my tenant ever since. I would also call your attention to the fact that a few weeks ago L.H. Chandler the U. States District attorney appeared before you, with myself who stated to you of his personal knowledge, that the facts and the law were as I have presented them, that he as attorney of the U. States, by Judge Underwood had libelled the property for confiscation under a mistake as to its true ownership and hence the suit had been dismissed by the clerk of U. States Court – I would also have you bear in mind, that I received a full Pardon from President Lincoln in March 1864, and became therefore immediately restored to all my rights of property, and among others, my right to enforce this deed of Lease against a delinquent Lessee — which I afterwards did, as above said, in Jun 1865 — This is my proof of title which I can add to if necessary -
